The aim behind Legal Zoning Plan no. 54/1 "Unteres Tor II" is to obtain building permission for a building complex with integrated retail facilities, a cinema, a medical center, office space, and hospitality on wasteland directly adjoining the Old Town (the "Neuer Markt" project. With regard to the project a referendum was held in fall 201, which approved the facilities and the size of the retail spaces (around 13,100 sqm.). In addition to the compatibility and configuration of the retail spaces (which are of relevance to the center and the increase in traffic, major issues in the legal zoning plan are the development of "Neuer Markt" and the associated noise emissions, in particular with regard to the sensitive residential facilities to the north. Experts' reports also examined the issues of air hygiene and hydro-geology in detail. Parallel to the drawing up of the legal zoning plan the preparatory land use plan was amended and a simplified regional planning procedure conducted. Following the beginning of construction work and in the course of marketing the planned spaces and progress with their construction, a need for adjustments in some areas emerged. The aim of the first amendment to the legal zoning plan was to slightly adapt the specifications with regard to the scale of the facility (the height of the physical structures), to the land that can be built on, and to make visual / design and functional improvements. Given that the relevant conditions of admissibility were in place, the first amendment to Legal Zoning Plan "Unteres Tor II" was made in a simplified procedure in accordance with section 13 of the German Building Code (BauGB). As a result of the simplified and accelerated procedure, for example doing without civic participation at an early stage as well as environmental assessment and an environmental report, the amendment procedure was concluded in just six months.
